Scope of Services: HarleyDesignStudios.com (hereafter referred to as HDS) provides comprehensive website design services, including but not limited to, website building, graphics, content creation, coding, and business development. We aim to deliver a high-quality, custom-designed website that meets your specific business needs and objectives.

Project Phases:

  1. Consultation and Planning:

    • Initial consultation to discuss your requirements, goals, and vision for the website.

    • Development of a project plan, including timelines, deliverables, and milestones.

    • Agreement on the scope of work, budget, and contract terms.

  2. Content Gathering:

    • Collection of all necessary content, including text, images, and other media.

    • Submission of all written content in Microsoft Word or Excel files, considered the final copy.

    • Approval of all graphics and graphic concepts.

  3. Design and Development:

    • Creation of design mockups and prototypes for client approval.

    • Development of the website, including creative writing, coding, graphic design, and integration of business development strategies.

    • Regular updates and reviews with the client to ensure alignment with the project scope.

  4. Testing and Revisions:

    • Thorough testing of the website for functionality, usability, and compatibility across different devices and browsers.

    • Implementation of client changes and revisions using a ticket system, processed in chronological order.

    • Final approval from the client before the website goes live.

  5. Launch and Support:

    • Launch of the website and monitor for any issues.

    • Post-launch support and maintenance, including updates and troubleshooting as needed.

Timeline:

  • HDS strives to complete website design projects within the agreed-upon timeline. However, delays caused by the client’s failure to provide necessary content, approvals, or other required information may result in extensions of the project timeline.

Client Responsibilities:

  • Timely submission of all required content and materials.

  • Prompt review and approval of design mockups, prototypes, and completed website pages.

  • Clear and concise communication regarding any changes or revisions.

Changes and Revisions:

  • Changes and revisions will be handled through a ticket system, and processed in chronological order.

  • Significant changes to the project scope may require a re-evaluation of the timeline and budget.

  • All change requests must be submitted via email.

Payments and Fees:

  • A detailed payment schedule will be outlined in the contract.

  • Additional fees may apply for consulting, training, or significant changes to the project scope.

  • Payments must be made on time to avoid project delays or hold.

Communication:

  • All project-related communication, including changes and updates, must be submitted via email.

  • Clients are encouraged to call for project updates no more than once every 72 hours.

  • Our business hours are 11 am to 7 pm Eastern Standard Time, Monday to Thursday, and 11 am to 3 pm on Saturday. We are closed on Sundays.

Cancellation and Refund Policy:

  • Cancellations must be communicated via phone for immediate processing.

  • Refunds are subject to a 25% paperwork processing fee if the cancellation occurs before the contract is signed.

  • Once the project has commenced and resources have been allocated, no refunds will be issued.

Quality Control:

  • All projects may be subjected to a fifteen-day waiting list due to the volume of quality control.

  • New clients will complete an approval form to ensure achievable expectations.

Logo and Branding Policy

Scope of Services: HarleyDesignStudios.com (hereafter referred to as HDS) provides comprehensive logo and branding services, including logo design, brand identity development, and brand strategy consulting. Our goal is to create a cohesive and impactful brand identity that resonates with your target audience and accurately represents your business.

Project Phases:

  1. Consultation and Discovery:

    • Initial consultation to understand your brand, target audience, and business goals.

    • Development of a brand strategy, including defining your brand’s values, mission, and vision.

    • Agreement on the scope of work, budget, and contract terms.

  2. Research and Concept Development:

    • Conducting market research and competitor analysis to inform the branding process.

    • Creation of initial logo concepts and brand elements based on the consultation and research.

    • Presentation of multiple design concepts for client feedback and selection.

  3. Design and Refinement:

    • Refinement of the selected logo concept based on client feedback.

Marketing Policy

Scope of Services: Promoting the Client's business is the most important job component. By using HDS marketing services, the Client can promote their business to all 50 states, allowing the public to see the Client's logo and identify it with the Client's service or product.

Schedule: HarleyDesignStudios.com (hereafter referred to as HDS) strives to market the Client's business according to HDS’s marketing schedule. HDS reserves the right to adjust the schedule and/or charge additional fees if the Client fails to meet deadlines agreed upon for the delivery of information, materials, approvals, payments, and for changes and/or additions to the services outlined in the Client's original order.

Indemnification: The Client will indemnify and hold harmless HDS, its subsidiaries, agents, employees, officers, and/or parent company, from any and all loss, cost, expense, and damages on any and all manner of claims, demands, actions, and proceedings that may be instituted, whether known or unknown, against HDS on the grounds that the marketing plan violates any copyright or proprietary rights of any person or entity.

Copywrite: HDS reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. The Client expressly understands that HDS, its subsidiaries, agents, employees, and/or parent company, is not liable for any damages resulting from the unwitting violation of copyright laws or illegal use of trade names or slogans. The Client represents and guarantees they have proper and legal title of all matter (in any form) submitted to HDS for publication. The Client further understands that HDS will rely upon such representation as grounds to engage in the mass printing and/or publication of the Client's material.

Errors: In the event that an error is discovered in the Client's marketing plan, the Client bears sole financial responsibility and must pay in full for the job. The Client agrees that, in the event HDS is liable for an error in print marketing, liability shall be limited to full credit for the re-print of the Client's marketing print no later than one (1) week after submission of the claim letter by the Client. To qualify for a credit, the Client must submit a claim in writing to HDS within three (3) days of receipt of the job. In no event will HDS or its licensees be liable for any damages beyond those set forth in this paragraph, or for any general, consequential, or special damages claimed to follow by reason of the error. HDS is not liable for failure to market the Client's business because of flood, fire, riots, strikes, national holidays, shortages of material, orders of government, failure of transportation, illness, acts of God, or other causes beyond the control of HDS. In such an event, this agreement will be suspended during the period of inability to perform, and the terms extended for a like period. Neither party shall be liable to the other because of this suspension.

Rights and Ownership: All tangible materials in all circumstances remain the property of HDS. All rights and ownership apply to preliminary concepts, works in progress, and finished material, whether the project is completed or canceled. If the Client wishes to make any additional use of the materials, the Client agrees to seek permission from HDS and make such payments as they are approved by the parties at that time. Where alterations or retakes are necessary, HDS will be given the opportunity to make such changes at an agreed additional charge.

Procedures: Clients meet with the project designer either on the phone or in person. The business developer, the project designer, and the client come to an overall direction on how all the purchased modules will work hand in hand with one another. The project designer uses HarleyDesignStudios.com resources team to develop the best up-to-date technology and interactive design possible.

The project designer will ask for ticket submission emails, over-the-phone meetings, business information (fill out paperwork), and website content. HarleyDesignStudios.com offers a business development package to get all the necessary information required for a live interactive marketing campaign.


Copyrights Policy

HDS reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. The Client expressly understands that HDS, its subsidiaries, agents, employees, and/or parent company, are not liable for any damages resulting from the unwitting violation of copyright laws or illegal use of trade names or slogans. The Client represents and guarantees they have proper and legal title of all matter (in any form) submitted to HDS for publication. The Client further understands that HDS will rely upon such representation as grounds to engage in the mass printing and/or publication of the Client's material.


Printing Policy

Schedule: HarleyDesignStudios.com (hereafter referred to as HDS) strives to print the Client's job(s) according to HDS’s published schedule. HDS reserves the right to adjust the schedule and/or charge additional fees if the Client fails to meet deadlines agreed upon for the delivery of information, materials, approvals, payments, and for changes and/or additions to the services outlined in the Client's original order. The printing turnaround times listed on this site are only estimates. In the unlikely event that HDS is late with the job, HDS's liability shall be limited to a 10% discount towards the Client's next job, but the Client must request this credit. In no event will HDS or its licensees assume liability for any damages beyond those set forth in this paragraph, or for any general, consequential, or special damages claimed to follow by reason of the delay.

Printing: HDS will reproduce color as closely as possible, but cannot exactly match color and density because of limitations in the printing process, as well as neighboring image ink requirements. This should be considered with the submission of critical color jobs. The accuracy of each color reproduction is guaranteed to be within 80-85% of the original work submitted. The color accuracy may be affected by factors outside our control and yours, including but not limited to the calibration of printers, monitors, proof stock and ink, color spectrum regarding the range of colors, and line screen.

Pre-design Artwork: HDS is not liable for the accuracy of any "pre-designed" artwork submitted by the Client. It is the Client's sole responsibility to proofread artwork and materials submitted to HDS, ensuring they are fully approved and print-ready.

Design Services: HDS agrees to provide the Client with all approved graphic design and print services specified in the Client's order. The Client shall be responsible for any and all fees in connection with such design services plus any reasonable and related additional services. HDS will keep the Client informed of additional services that are required and obtain the Client's prior approval for any services that cause the total fees to exceed those outlined in the order form. Upon completion of the design, HDS will provide the Client with a proof via the web, which shall be used by the Client. This layout is not intended as an exact color proof. An email or written agreement will be given to HDS on the agreed-upon time and date to ensure the delivery date of the final product. The Client is 100% responsible for payment of their job after an email or written agreement has been given to HDS. HDS is not liable for errors in the Client's artwork or ad copy after the approval, as it is the Client's sole responsibility to ensure the content of the proof conforms to their original design.

Alterations/Corrections: Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rates. HDS cannot be held responsible for any mistake in alterations communicated verbally.

Tag Lines: HDS reserves the right to tag all orders 4x6 or larger. You may request to have it removed for a cost of $25 per file.

Quotations/Estimates: Prices posted on this website are subject to change without notice. Written estimates are valid for 30 days. An estimate not accepted within 30 days may be subject to change.

Accuracy of Specifications: Quotes are based on the accuracy of the specifications provided. HDS can re-quote a job at the time of submission if the art does not conform to the information on which the original estimate was based. Orders placed with HDS are to the Client's knowledge correct, and there are no conditions or agreements relating to the orders which are not written or accompanying said order.

Shipping: In the event the Client requires delivery/shipping, HDS will send the job using third-party companies such as Federal Express, UPS, or a courier service. In the event that a third-party shipper is responsible for the lateness of or damage to the Client's job, HDS will not be liable for any resulting damages. Charges for the delivery of materials and supplies from the Client or the Client's supplier to HDS are not included in quotations unless specified.

Shipping Times & Postal Delivery: HDS has no control over the U.S. Postal Service, United Parcel Service, or any other common carriers' delivery schedules and cannot guarantee when mail or shipments deposited with or released to these carriers will be delivered.

Postal Regulations: You are 100% responsible for complying with current postal regulations.

Rights and Ownership: All tangible materials in all circumstances remain the property of HDS. All rights and ownership apply to preliminary concepts, works in progress, and finished material, whether the project is completed or canceled. The Client will be entitled to limited and specific usage rights of such materials only for the purpose of reproduction, after which all materials will be returned, unaltered, to HDS within thirty (30) days of use. Upon the Client's payment of all fees and expenses, HDS will grant all reproduction and/or usage rights for all approved final materials created by HDS for this project. If the Client wishes to make any additional use of the materials, the Client agrees to seek permission from HDS and make such payments as they are approved by the parties at that time. Where alterations or retakes are necessary, HDS will be given the opportunity to make such changes at an agreed additional charge.

Rights to Refuse: Our print company reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. The Client expressly understands that HDS, its subsidiaries, agents, employees, and/or parent company, is not liable for any damages resulting from an unwitting violation of copyright laws or illegal use of trade names or slogans. The Client represents and guarantees they have proper and legal title of all matter (of any form) submitted to our print company for printing and/or publication. The Client further understands that HDS will rely upon such representation as grounds to engage in the mass printing and/or publication of the Client's material.

Indemnifications: The Client will indemnify and hold harmless the printer, HDS, its subsidiaries, agents, employees, officers, and/or parent company, from any and all loss, cost, expense, and damages on any and all manner of claims, demands, actions, and proceedings that may be instituted, whether known or unknown, against HDS on the grounds that said printing violates any copyright or any proprietary right of any person or entity.

Samples: The Client will provide HDS with samples of each printed or manufactured design. HDS reserves the right to distribute free samples of the Client's printed material. HDS may use your product for samples or advertising purposes.

Will Call: Will Call orders will be kept for 30 days from the delivery of the notification phone call. Orders left at HDS for more than 30 days will be considered abandoned and be recycled.

Cancellations: Canceled orders require compensation for incurred costs and related obligations at the time of cancellation. Due to the speed of our turnaround, the Client may only cancel a job on the same business day of order placement. Clients are responsible for all costs incurred for jobs canceled before our evening cutoff time of 3 pm on the day the order was placed. No refunds will be given for orders canceled after 6 pm on the same business day the order was placed. All sales are final. Refunds are not available on orders unless files have not been prepared for printing and production has not commenced.

Acceptance: HDS is hereby authorized to furnish all materials and labor to complete the work mentioned in the above proposal, for which the Client and HDS agree to pay the amount mentioned in the agreement according to its terms.


Consulting Policy

Client agrees to adhere to this clause as HarleyDesignStudios.com (HDS) sees fit. Clients will be billed biweekly, and all bills must be paid in full on the day of receipt, or the project will be placed on hold with a $100 restoration fee. When you purchase a website, the costs cover only the building, graphics, and changes. Any consulting or training during any design process will incur additional costs.

  1. Consulting Fee: At any time, the client may be asked for a $500.00 consulting fee. If the client exceeds the sales content provided to the public information on HarleyDesignStudios.com and custom consulting for their business development begins, the $500.00 consulting fee will apply. The client will be notified verbally to continue this conversation because at this point they are crossing over into custom business development training/consulting, and a payment will be required before any future consulting or training continues. HDS reserves the right to refuse consulting and training via Skype, email, text messaging, phone calls, and/or walk-ins if payment has not been completed. If the client exceeds more than one topic, a $42.50 per hour charge, per consultant, will apply.

  2. Processing and Customer Service Fees: During or at the start of any project, additional processing or customer service fees may apply. This may depend on the size of the project, unforeseen circumstances, and lack of information provided before the project was quoted and sold. Any additional upgrades that might affect this particular project or dealing with products/services not sold by HDS will incur a $45.00 per hour fee to place the project back within scope or to get started.

  3. Open Paperwork and Processing: Clients with open projects will be charged $20.00 weekly from the time the contract starts until the project is completed.

  4. Project Status Requests: Client requests for project statuses and updates will be charged a $100.00 fee to reanalyze their folder, deem project progress, outline next steps, and determine what is needed for completion. The client may receive this update re-emailed once before incurring a $5.00 repetitive re-send email charge.

  5. Gathering Content Emails: Each piece of content in the email, or as many emails as are sent to the client, will incur a $5.00 charge to decipher and organize client content.

  6. Phone Call Consultation or Training: One-time free consultation: The first phone call consultation or training session is free of charge. Subsequent calls will be billed as follows: a. Website Analysis - a verbal analysis will be $100.00 b. Business Development - related to the current project will be $50.00 c. Business Development - unrelated to a contracted project will be $250.00

  7. In-Office Business Development: This includes gathering files, reviewing project scope, discussing marketing, developing website tactics, and professional sales presentations. The fee for this service is $500.00.

  8. Non-Contract Fixes: If HDS fixes something not covered in the contract, such as issues with Microsoft Outlook, hackers, lost passwords, or damages caused by friends and family, the client will be billed $175 per hour.

  9. Repetitive Issue Calls: If the client calls about the same issue more than twice, and HDS must explain something more than twice regarding the current project scope, every additional phone call will incur a $25.00 fee, including voicemails.

  10. Hosting Fees: If the client chooses to host with another company, there is a $250.00 upload fee or more. If the client chooses to host with Interactive Success, the starting price is $420.00 per year (covering hosting, maintenance, administration, and hacker protection, with prices varying depending on the size of the site).


Refund Policy

Once the paperwork is signed and/or any creative design interactions, emails, graphics, or designs have commenced, all necessary resources have been allocated to complete the project scope. Due to this fact, there is a no refund policy. If a deposit or any form of currency has been given before the paperwork is signed, a 25% paperwork processing fee will be deducted before the refund is given.

The client has taken the time and effort to choose HarleyDesignStudios.com /Interactive Success LLC, which is a creative service. At that point, the client is considered satisfied with HDS’s creative service. There are many steps in the business process that begin once your paperwork is signed and/or any creative design interactions, emails, graphics, or designs have started. Most importantly, allocating the resources and processing the paperwork with all the design professionals necessary to meet project scope expectations.


Quality Policy

Fifteen-Day Waiting List: Currently, all changes, new projects, and ongoing projects may be subjected to a fifteen-day waiting list due to the heavy volume of quality control. New clients will be required to complete an approval form to ensure that their expectations are achievable. This quality control policy may or may not apply to you, but it benefits all final products if it does. Due to our extensive experience with numerous projects, this new quality control policy will help prevent future disorganization, and excessive changes in stage three, save time overall, and potentially eliminate the fifteen-day waiting list in the future. This policy aims to organize your company and deliver the quality product you expect in the shortest possible time.

Project Stages:

  • Stage One: Content Gathering – Strong organization is required. All written content must be submitted in Microsoft Word or Excel files and considered the final copy. All graphics and graphic concepts will be approved, and the project scope will be reviewed and approved multiple times before proceeding to stage two.

  • Stage Two: Website Building Process – This includes creative writing, coding, graphic designs, and business development. After completing stage one, there is no guarantee that stage two will commence immediately, as it depends on the timely submission of content. Professionals will be appointed to different parts of your project scope, but availability may result in a waiting list.

  • Stage Three: Test Trial and Changes – Changes may be required during this stage. A ticket system is in place to handle client changes and revisions in chronological order. Customization, time, effort, and understanding the final expected result are crucial.

Client Changes: We follow a ticket system to handle and decipher all client changes and revisions after the website is built. These changes are processed in chronological order. While we strive to get as close to the completed product as possible during the initial design process, there is a lot of customization involved. Delays in submitting changes can alter the timeframe, and resending information may be required if not received.

Communication: All information and changes must be submitted via email; no information will be accepted over the phone. Clients are encouraged to call in and submit project updates no more than once every 72 hours. Our business hours are 11 am to 7 pm Eastern Standard Time, Monday to Thursday, 11 am to 3 pm on Saturday, and we are closed on Sundays. Preferably, we would like to keep all phone calls during appropriate business hours for organizational purposes.

Communications Policy

In the event that the client wishes to share any and all business conducted between HarleyDesignStudios.com and their company, additional fees may apply and pre-authorization from HarleyDesignStudios.com is required to share any and all content. This Privacy Policy applies to any and all emails as well as any forms of communication such as Skype or mobile phones and/or content delivery.
